Licensed in Texas and Oklahoma

QUICK SUMMARY

McKade Lively is licensed as a mortgage loan originator in Texas and in Oklahoma, NMLS 2704474, through American Pacific Mortgage Corporation, doing business as True North Home Loans, company NMLS 1850. The license follows the activity the state regulates. The property's state still controls the contract, the homestead law, the title process, and the tax exemptions. A Texas option period does not exist on an Oklahoma contract just because the loan officer knows Texas.

You can check any loan officer's license yourself on NMLS Consumer Access, the free public lookup run by the Nationwide Multistate Licensing System (NMLS Consumer Access). Search by name or NMLS number and the record shows the states where the person is licensed or registered, the company they work for, and any public regulatory actions. In Texas, residential mortgage loan originators are licensed and supervised by the Texas Department of Savings and Mortgage Lending, which also has public information on licensing (Texas SML). The state where the house sits decides which state's contract, title and property tax rules apply to your purchase.

How to check a license in a few minutes

  1. Go to NMLS Consumer Access and search the loan officer's name or NMLS ID.
  2. Open the individual record and look at the state licenses and registrations section. Make sure Texas is listed as active for a Texas property.
  3. Check the employer listed on the record. It should match the company on your Loan Estimate.
  4. Look up the company's own NMLS number too.
  5. Read any regulatory actions listed.

Your Loan Estimate and Closing Disclosure must show the loan originator's and the lender's NMLS IDs (12 CFR 1026.37(k)). See how to read an NMLS record. My NMLS ID is 2704474, and the company, American Pacific Mortgage Corporation dba True North Home Loans, is NMLS 1850.

The house decides the law

Where you live today does not decide which state's real estate rules apply. The property does. A Fort Worth house uses:

  • The TREC contract forms for the purchase (TREC No. 20-19).
  • Texas title insurance, with premiums set by the state.
  • The Texas Constitution's homestead rules.
  • The local appraisal district for property taxes.

This library is written for Texas properties, with a Fort Worth and Tarrant County focus.

If you are moving to Fort Worth from another state

  • Your Fort Worth purchase is a Texas file, even if you still own a home elsewhere.
  • If you are selling a home in another state, that sale follows that state's rules and closing customs.
  • Your old home's mortgage, taxes and insurance still count in your debt-to-income ratio until it is sold, unless the program's rules for a departing residence apply.
  • A Texas homestead exemption applies only to a Texas home you own and occupy. See the homestead exemption.

Fictional example

Fictional example: a buyer moving to Fort Worth for a new job compares two loan officers. The buyer checks both on NMLS Consumer Access, confirms each has an active Texas license, and checks that each record's employer matches the company on the Loan Estimate. The buyer then compares the two Loan Estimates on price and terms. The license is the identity check. The Loan Estimate is the price comparison.

Common mistakes

  • Using the license number as a price comparison. It only tells you who the person is and where they can lend.
  • Assuming a loan officer licensed in one state can originate a loan on a Texas property.
  • Forgetting that the employer on the record should match the lender on your disclosures.
