When a Standard Agency Loan Does Not Fit

QUICK SUMMARY

A standard agency loan means a Fannie Mae, Freddie Mac, FHA, VA, or USDA path that fits the published guides and the lender's overlays. When that path fails, the next step is not always "get denied and quit." It may be a different occupancy or product, a repair of the credit or income file, manual underwriting where the guide allows it, a portfolio loan the lender keeps, or a non-QM investor path such as bank statements, asset depletion, or DSCR. A denial on one channel is information. It is not a diagnosis by itself.

When a standard agency loan, meaning FHA, VA, USDA or a conventional loan sold to Fannie Mae or Freddie Mac, does not fit, the first step is finding out exactly why. Some problems are temporary and fixable with documents, time or a different structure. Some are structural, such as tax returns that do not support the payment. Only after that diagnosis does a non-QM loan become the honest next question. Non-QM loans are not a shortcut; they follow their own investor rules. Requirements vary by investor and loan structure.

Start with the reason

A file that does not fit usually fails on one of these:

  • Income method. Self-employed income after write-offs, new income without history, or income that cannot be documented the way the program requires.
  • Credit. A recent credit event still inside a waiting period, or a score below the program's requirement.
  • Debt-to-income. The payment plus debts is too high for the finding.
  • Assets. Large undocumented deposits or not enough reserves.
  • Property. Condition, property type or a condo project that is not eligible.
  • Occupancy. An investment property qualified on rent, which agency rules handle in specific ways.

Fixes inside the agency programs

  • Documentation. A missing statement page, a gift letter, or a letter of explanation can change a finding.
  • Restructuring. A different loan amount, a co-borrower, or paying off a debt.
  • A different program. A file that does not fit conventional may fit FHA, VA or USDA, and the reverse.
  • Manual underwriting. FHA allows manual underwriting when TOTAL Scorecard returns a Refer, if the file meets HUD's manual standards (HUD 4000.1 II.A.5). I offer FHA manual underwriting. It is a guideline path with specific requirements, not a favor. See manual underwriting.
  • Time. Waiting out a seasoning period or building a second year of self-employment history.

An automated finding is a recommendation built from the data entered. A Refer with Caution from Desktop Underwriter means the loan is not eligible for delivery to Fannie Mae as submitted (Fannie Mae B3-2-07). Correcting data or structure can change it. See what DU and LPA findings mean.

When non-QM is the honest conversation

If the tax returns truly will not support the payment, or the property is an investment qualified on its rent, non-QM documentation methods may fit:

  • Bank statement loans for self-employed borrowers.
  • DSCR loans for investment properties, qualified on property cash flow.
  • Asset-based qualification for borrowers with large savings.

A non-QM loan still has to meet the federal ability-to-repay rule for most consumer home loans (12 CFR 1026.43). It just does not use the qualified mortgage safe harbor. "Portfolio" and "non-QM" are not synonyms: a portfolio loan means the lender keeps it, and it may or may not be a qualified mortgage. See non-QM loans.

Fictional example

Fictional example: a Fort Worth self-employed buyer receives a conventional finding that does not approve the loan because the tax returns, after legal write-offs, do not support the payment. Business deposits have been consistent for two years. The useful questions are whether FHA's rules would treat the income differently, whether waiting for the next tax year helps, and whether a bank statement loan fits. The buyer compares all three on cost, timing and terms before choosing.

Common mistakes

  • Jumping to non-QM without knowing why the agency file failed.
  • Shopping lender after lender with the same data and expecting a different result.
  • Treating a Refer finding as a final denial.

If you were already turned down, read denied by another lender first.

Next step

If a standard loan did not work, send me the reason you were given and I will tell you honestly whether it is fixable inside the agency programs or whether a non-QM option is worth comparing. Book a call, or start an application.
